Terms of Use

These Terms of Use ("Terms") form a binding agreement between you ("you", "User") and the operator of humans.top ("we", "us", "Service"). By accessing or using the Service you accept these Terms in full. If you do not accept them, do not use the Service.
1. Nature of the Service
1.1. humans.top is an informational website. It assigns each registered user a sequential public number and displays a public rating list together with optional user-supplied data (display name, "about" text, photos, status).
1.2. The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, non-infringement, uptime, or absence of errors.
1.3. Nothing on the Service constitutes legal, financial, medical, employment, investment, identity, reputation, or any other professional advice or certification, and must not be relied upon as such.
2. Rating and Algorithm
2.1. A user's position, score, tier and status on humans.top are computed and recomputed automatically by a closed, proprietary algorithm. The algorithm, its inputs, its weights, the timing of its execution and the resulting values are determined solely by us and may change at any time without notice.
2.2. The rating does not purport to be accurate, complete, fair, objective or representative of any real-world property of the user, of any group of users, or of humans in general. It is generated for entertainment and informational purposes only.
2.3. Rating values are final: we do not appeal, recalculate on request, restore, freeze, or transfer them. The rating is generated for entertainment and makes no claim of correctness, accuracy or fairness, so it is not a factual statement about you that could be "wrong". Nothing in this section limits any non-waivable right you may have under the mandatory consumer-protection law of your jurisdiction.
2.4. We may, at our sole discretion and without notice or liability, change, recompute, freeze, hide, remove, anonymize, demote, promote, merge or split any account, number, profile, photo, status or rating entry.
3. Eligibility and Account
3.1. You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is higher), and legally competent to enter into binding contracts.
3.2. You are responsible for everything that happens under your account, including all content you submit and all payments you make. Keep your credentials secret.
3.3. You may only register one account. Multi-accounting, impersonation, automated registration, scraping and circumvention of any technical limit are prohibited and are grounds for immediate termination without refund.
4. User Content
4.1. You retain ownership of content you submit (display name, "about" text, photo, etc.) but grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to host, store, reproduce, display, distribute, adapt and publicly perform that content for the purpose of operating, promoting and improving the Service.
4.2. You represent and warrant that you own or have all necessary rights to the content you submit, that it does not infringe any third-party rights and that it complies with section 5.
4.3. We may remove or modify any content at any time, with or without notice and at our sole discretion.
4.4. Open data. Your public profile fields (display name, "about" text, photos, public number, rank, tier) are intentionally exposed to search engines and AI/LLM training pipelines, and may be published in an open dataset under a CC0 1.0 public-domain dedication on third-party platforms (such as GitHub, Hugging Face and Kaggle). By submitting public content you grant this use and acknowledge it cannot be retroactively revoked from copies already distributed or models already trained. Your email address and score history are never published this way.
5. Prohibited Conduct
You agree not to, and not to attempt to:
- post unlawful, infringing, defamatory, obscene, sexually explicit, hateful, harassing or threatening content; content depicting minors in any sexualised context; content that promotes violence, terrorism, self-harm or illegal drugs;
- impersonate any person or entity;
- upload malware, attempt to gain unauthorised access, probe or test the security of the Service, or interfere with its operation;
- use the Service to launder money, fund sanctioned parties, or violate any export-control or anti-corruption law;
- use the Service from a jurisdiction in which it is unlawful for you to do so.
Violation of this section results in immediate termination without refund and, where applicable, in referral to law enforcement.
6. Payments
6.1. Payments are made exclusively through Apple In-App Purchase (StoreKit 2) in the Top Humans iOS app. There is no payment surface on the web or in the Android app — to support their score, users must install the iOS app.
6.2. Payment data (card numbers, banking details, etc.) is collected, transmitted, processed and stored by Apple, not by us. We never receive your card number. We are not responsible for any act, omission, error, outage, fraud, hold, reversal, dispute, exchange-rate movement or fee on the side of Apple or any of its payment partners.
6.3. All amounts are expressed in U.S. dollars (USD) unless stated otherwise. Apple converts to your local currency at its own rates; we receive the resulting payout in USD.
6.4. Payments are made voluntarily. They do not purchase goods, services, ranking, position, status, advantage, immunity, refund right, dispute right, account-restoration right, customer-support obligation, or any other consideration from us. Any effect of a payment on the rating, if any, is solely the result of the automatic algorithm described in section 2 and is not a paid service.
6.5. You acknowledge that the Service is informational and that payments are non-refundable from us, subject only to any non-waivable consumer-law right that applies to you under your local law and to Apple's own refund policy.
7. Refunds
7.1. Refunds for in-app purchases are handled directly by Apple. Because purchases are one-time (consumable) and there are no subscriptions, request a refund at reportaproblem.apple.com, or in the App Store via your account → Purchase History → Report a Problem. Apple's refund policy applies.
7.2. When Apple notifies us that a purchase has been refunded or revoked (via App Store Server Notifications V2), we automatically reverse the score grant for that purchase.
7.3. We do not separately accept refund requests, chargebacks or disputes outside the Apple flow.
8. Termination
8.1. We may suspend or terminate your access at any time, with or without notice, with or without cause, at our sole discretion.
8.2. Termination does not entitle you to any refund except as expressly provided in section 7.
8.3. Sections that by their nature should survive termination (including 2, 4.1, 5, 6, 7, 9, 10, 11, 12, 13) survive termination.
9. Disclaimer of Warranties
To the maximum extent permitted by law, the Service, including all content, ratings, numbers, profiles, photos, statuses, algorithms, calculations, communications and payment flows, is provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, currency, timeliness, availability, security, freedom from errors or viruses, or any warranty arising from course of dealing or trade usage. We do not warrant that the Service will meet your requirements or that any defect will be corrected.
10. Limitation of Liability
10.1. To the maximum extent permitted by law, in no event will we, our affiliates, officers, directors, employees, contractors, agents or licensors be liable to you for any indirect, incidental, special, consequential, exemplary or punitive damages, including but not limited to lost profits, lost revenue, lost data, lost goodwill, business interruption, reputational harm or distress, arising out of or in connection with the Service, the rating, any algorithmic output, any payment, any refund or refusal of refund, any third-party act, or these Terms, whether in contract, tort, statute, equity or any other theory, even if we have been advised of the possibility of such damages.
10.2. Our total cumulative liability to you for all claims arising out of or in connection with the Service, regardless of theory, shall not exceed the total amount actually settled on our receiving account from you in the 12 months immediately preceding the event giving rise to the claim, or USD 50, whichever is lower.
10.3. Some jurisdictions do not allow exclusion of certain warranties or limitation of certain liabilities. In those jurisdictions our liability is limited to the maximum extent permitted by law and no further.
10.4. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
11. Indemnification
To the extent permitted by applicable law, you will defend, indemnify and hold harmless us and our affiliates, officers, directors, employees, contractors, agents and licensors from and against any third-party claim, demand, loss, liability, damage, fine, penalty, fee or expense (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your content; (c) your breach of these Terms; (d) your violation of any law or third-party right. This indemnity does not apply to your exercise of any right granted to you by mandatory consumer-protection law, including requesting a refund or disputing a charge through Apple or your payment provider.
12. Privacy
We process personal data as described in our Privacy Policy, available on the Service. By using the Service you consent to that processing. We process the minimum data needed to operate the Service (account identifiers, login provider id, IP, user-agent, payment-processor reference id, content you submit) on the legal basis of contract performance and our legitimate interest in running the Service.
13. Governing Law and Disputes
13.1. These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-laws rules. Where mandatory consumer-protection rules of your jurisdiction grant you stronger non-waivable rights, those rules apply to the extent of the conflict.
13.2. Any dispute arising out of or in connection with the Service or these Terms must first be raised with us in writing and, where possible, resolved by good-faith negotiation. If not resolved within 60 days, the dispute is subject to the exclusive jurisdiction of the competent courts of the Service operator's seat, subject to any non-waivable consumer-jurisdiction rule that applies to you.
13.3. Class actions and class arbitrations are waived to the maximum extent permitted by law. You may bring claims only on an individual basis, except where mandatory law in your jurisdiction grants you a non-waivable right to collective redress, which this section does not limit.
14. Changes to the Terms
We may update these Terms at any time. The current version, with its effective date, is always at this URL. Continued use of the Service after a change constitutes acceptance of the updated Terms. If you do not accept a change, stop using the Service.
15. Miscellaneous
15.1. If any provision is held unenforceable, the remaining provisions remain in effect and the unenforceable provision is reformed to the minimum extent necessary.
15.2. Our failure to enforce any provision is not a waiver of that provision or of any other provision.
15.3. You may not assign these Terms. We may assign them to any successor.
15.4. These Terms are the entire agreement between you and us regarding the Service and supersede any prior agreement.
15.5. Headings are for convenience only and do not affect interpretation.
humans.top is operated on an informational basis. No warranties. Payments are voluntary, non-refundable except as set out in section 7. Rating is algorithmic and cannot be disputed.
